Pinadaling proseso ng pag-aampon, aprubado sa Palasyo

Nilagdaan ni Pangulong Rodrigo Duterte upang magsilbing ganap na batas ang panukalang magpapadali sa proseso ng pag-aampon sa bansa.

Pinirmahan ng Punong Ehekutibo ang Simulated Birth Rectification Act noon pang Pebrero 21 ngunit nito lamang Huwebes naipamahagi ang kopya ng batas sa mga mamamahayag.

Nakasaad sa batas na tinutukoy ang birth simulation bilang pagkilos ng civil registry upang mapalabas sa record na isinilang ang bata sa isang tao na hindi niya biological mother.

Sa ilalim ng bagong batas na ito, pagkakalooban ng amnestiya at pahihintulutan ang rektipikasyon ng simulated birth ng isang bata kung saan ginawa ang simulation para sa pinakamabuting interes ng bata.

Nakapaloob din dito na “person or persons who, prior to the effectivity of this Act, simulated the birth of a child, and those who cooperated in the execution of such simulation, shall not be criminally liable for such act provided that the simulation of birth was made for the best interest of the child and that the child has been consistently considered and treated by such person or persons his, her, or their own daughter or son.”

Nakalagay din sa batas na ang sinumang tao o mga tao na gumawa ng simulation para sa kapanganakan ng isang bata “may avail of administrative proceedings for the adoption and rectification of the simulated birth record of a child provided that the child has been living with the person for at least three years before the effectivity of the law.”

Batay sa Section 6 ng bagong batas, “all petitions, documents, records, and papers relating to adoption and rectification of simulated births” ay hindi maaaring gamitin bilang “evidence against those who simulated the birth of a child or who cooperated in the execution of such simulation in any criminal, civil, or administrative proceeding.”

Kasama sa mga requirement para sa administrative adoption na dapat isang Filipino citizen na nasa tamang edad, na may kompletong karapatang sibil at legal, may mabuting karakter at asal, hindi nahatulan ng anumang krimen, may kakayahang emosyonal at saykolohikal para mangalaga sa isang bata at nasa posisyon upang masuportahan at mapangalagaan ang bata sa isang tunay na pamilya.

“In case of adoption by a married couple, where one of the adopters is a foreign national married to a Filipino, the law stated that the foreign national must have been residing in the Philippines for at least three continuous years prior to the filing of the petition for adoption and application for rectification of simulated birth record,” dagdag pa ng batas.

Kinakailangan din ang sertipikong magdedeklarang legal na maaaring ampunin ang isang bata mula sa Department of Social Welfare and Development (DSWD).

Sa sandaling nakumpleto na ang mga requirement, isusumite naman ang petisyon sa social welfare and development office ng lungsod o munisipalidad.

Rerebisahin ito ng regional director at saka dadalhin sa tanggapan ng Kalihim ng DSWD.

“The adoptee shall be considered the legitimate daughter or son of the adopter for all intents and purposes and as such is entitled to all the rights and obligations provided by law to legitimate daughters or sons born to them without discrimination of any kind,” ayon pa rin sa batas.
